Dear all,

My colleague Wayne Jocic has written a note on Mann v Paterson Constructions for our Opinions on High blog. I thought this would be of interest to list members. Among other things, he considers where the law is with regard to the choice between contract damages and quantum merits after Mann, the status and pleading of restitution in Australia, and the question of whether the contractual amount caps the amount of a quantum meruit.
